Agricultural Land Commission Act

General Order #291/89

Subdivision and Non-farm Uses within the Agricultural Land Reserve in the area generally known as the Southlands area within the City of Vancouver

 
WHEREAS Section 20 of the Agricultural Land Commission Act prohibits the use of agricultural land in any Agricultural Land Reserve for any purpose other than farm use, except as permitted by the Act, the regulations or an order of the Commission, on terms the Commission may impose;

AND WHEREAS Section 18 of the Agricultural Land Commission Act prohibits

a)  a local government, or an authority, a board or another agency established by it or a person or agency that enters into an agreement under the Local Services Act from permitting non-farm use of agricultural land or permit a building to be erected except for farm use, or approve more than one residence on a parcel of land unless additional residences are necessary for farm use;

b)  an approving officer under the Land Title Act, the Local Government Act or the Strata Property Act or a person who exercises the powers of an approving officer under any other Act to approve a subdivision of agricultural land;

AND WHEREAS Section 19 of the Agricultural Land Commission Act prohibits a Registrar of Titles from accepting an application for deposit of a subdivision, reference, explanatory or other plan showing subdivision of land or permitting a new parcel of land by a metes and bounds description or an abbreviated description, under the Land Title Act, or the Strata Property Act all or part of which consists of land in the Agricultural Land Reserve;

AND WHEREAS the Agricultural Land Commission has completed an extensive consultative process with the City of Vancouver regarding lands in the Southlands area, which process resulted in the Agricultural Land Commission reviewing and endorsing the "Southlands Plan", the "Southlands RA1 Guidelines" and Bylaw No. 6223 which created the RA1 District Schedule;

AND WHEREAS the Commission requiring the owners of property within the Southlands area to make application under the Agricultural Land Commission Act to allow the uses and subdivisions permitted within the RA1 District Schedule of the City of Vancouver Bylaw No. 6223 creates unnecessary administration and delay for the Agricultural Land Commission, the City of Vancouver, and the property owners;

NOW THEREFORE I hereby certify that the Agricultural Land Commission, by Resolution 291/89 dated the 5th day of April 1989, made an order of General Application pursuant to section 18, 19, and 20 of the Agricultural Land Commission Act to apply to those lands within the Southlands area of the City of Vancouver, more specifically described in the attached Schedule A, that lie within the Agricultural Land Reserve of the Greater Vancouver Regional District:
   a) to allow any property owner to use or subdivide lands provided the use or subdivision is in accordance with the provisions of the RA1 District Schedule as adopted by the City of Vancouver by Bylaw No. 6223 on the 6th day of October 1987;
b) to allow the City of Vancouver and the Approving Officer to issue any required permits or approvals provided such are in compliance with the provisions of the RA1 District Schedule as adopted by the City of Vancouver Bylaw No. 6223 on the 6th day of October 1987; and
c) to authorize the Registrar of Titles to accept an application for deposit of a subdivision, reference, explanatory or other plan showing subdivision of land or permit a new parcel of land by a metes and bounds description or an abbreviated description, under the Land Title Act, or the Strata Property Act provided it is in compliance with the provisions of the RA1 District Schedule as adopted by the City of Vancouver by Bylaw No. 6223 on the 6th day of October 1987;

Subject to compliance with all other applicable legislation.
