How Do I Reconsider or Appeal a Decision

Decisions Relating to Applications

A landowner who has land in the ALR may make application to the Agricultural Land Commission to remove, subdivide or use the land for non-farm purposes. A landowner may request that a decision of the Commission be reconsidered by:

  • Supplying evidence not previously considered by the Commission, or

  • Supplying evidence that the decision was based on information that was in error or false.

There is no appeal provision except on a question of law or excess of jurisdiction to the Supreme Court of British Columbia.
 

Decisions Relating to Stop Work Orders, Determinations, Remediation Orders and Penalties

A person who is subject of a stop work order, determination, remediation order or penalty, may appeal to the Agricultural Land Commission. Written notice is required and must include the grounds for the appeal and the relief requested. The notice must be filed within 60 days.

The Commission must hold a hearing to consider the appeal.
