Farm Practices Protection Act
The Farm Practices Protection (Right to Farm) Act is complementary to the ALR farm land preservation program. This Act, which came into effect in 1995, gives farmers the right to farm in the ALR and on land zoned for farm use.
The Act protects farmers that are using normal farm practices from nuisance lawsuits and nuisance bylaws of local governments. The Act also establishes a process to resolve concerns and complaints in order to:
Let farmers farm;
Keep people out of court;
Deal fairly with people's concerns and complaints; and
Deal with poor farm practices.
This Act is administered by the Ministry of Agriculture, Food and Fisheries. For further information, click here.
