Delegation of Decision Making to Agencies

The Agricultural Land Commission Act extended the ability of the Commission to delegate certain decision making to an "authority". "Authority" is defined in the Act as "an agent of governemnt, a public body or public officer" with whom the Commission has an agreement.

The legislation provides for the Commission and authority to negotiate specific uses in specified areas that would not require an application subject to terms and conditions contained in the agreement. Agencies such as Land and Water BC and the Oil and Gas Commission could enter into an agreement with the Commission in order to reduce duplication of similar application requirements and streamline processing while continuing to ensure that the preservation of and impacts on ALR lands are considered.

The Agricultural Land Commission retains the right to withdraw a delegation agreement if the terms of the agreement are not adhered to. Local governments will be consulted during the process of negotiating a delegation agreement with an authority.

The Act also provides for the Commission to delegate certain decision making to local governments. See Working with Local Governments for further information.
